“We appreciate the Chief Hearing Examiner’s ruling, which confirms that the conduct and integrity of the management seeking control of Dominion are relevant to the Commission’s review. NextEra and Dominion asked the Commission to approve this deal on the strength of NextEra’s track record and ‘core values.’ Today’s ruling confirms that those claims can be tested, not simply taken at face value.
As the ruling put it, a public utility ‘and any entity that controls it’ is more than the people who keep the lights on, and the responsibilities of its management and board are far broader. How NextEra’s leadership responded to serious allegations about Florida Power & Light’s use of corporate resources to influence elections and target officials goes directly to how it would govern Dominion.
NextEra must now produce the so-called Robo Memorandum, the records of the internal investigation its former chairman described to investors, its contracts and payments with political consulting firms, and the materials it gave the Jacksonville City Council’s investigative committee about its failed bid to acquire JEA, Jacksonville’s public utility. Virginia ratepayers deserve a full and transparent record before the Commission decides whether to hand control of Dominion to NextEra. We look forward to reviewing these documents.”
